The Legal Status of CBD Oil in Canada

Nowadays, almost every other week there is a viral post that reports one or two miraculous effects of CBD oil on yet another condition. From significantly reduced epileptic seizures in children to the management of PTSD in veterans, the internet is awash with stories documenting the numerous benefits of taking CBD.

A quick look at the internets will reveal that CBD oil has over a dozen proven benefits.

It:

However, even as more and more benefits and proofs get reported, there is a question of whether it is really permitted for use by the federal government in Canada.

CBD newbies who have never used the oil are worried about its legal status. This is natural considering the fact that CBD is related to cannabis and cannabis has for the longest time been illegal in this country (until June this year).

In this article, we are going to show you the exact laws governing the use of cannabis oil in Canada.

But before we get to that important bit, here is something you should just so we are on the same page. CBD oil can be derived from the marijuana plant or from the related industrial hemp plant. When it comes from the hemp plant it is referred to as hemp oil. So we may in the article refer to CBD oil as hemp oil and vice versa.

When it is derived from the marijuana plant it is known as cannabis oil.

So what is the legal status of CBD oil?

The long story short, cannabis oil is permitted for use in the whole of Canada. Just in the same way that marijuana will be legal in the whole of Canada starting this October. Nevertheless, the form of CBD oil that is currently lawful in the country is that one which is derived from the industrial hemp plant.

Furthermore, even though hemp oil is legal nationwide, there are rules [see the next section].

How do we know hemp oil is permitted for use?

This is easy. According to Health Canada, a federal institution under the ministry of health that is mandated with helping Canadians improve their health, clearly states that the Industrial Hemp Regulations allow the cultivation and processing of the industrial hemp plant for commercial purposes. In layman terms, the plant can be grown and oil extracted for commercial use.

“So what are the rules?”

This is a question we have been asked repeatedly by some of our readers who know that hemp plant is legal nationwide.

There are many rules but there is only one major one you need to remember, the industrial hemp plant includes cannabis plants and any of its parts that contain 0.3% THC (tetrahydrocannabinol).

So basically, anything with less than o.3% THC is not a controlled substance. Moreover, if you click on the link on “Health Canada” you will see that the definition of industrial hemp includes derivatives of any the plant and their parts (except the leaves and the flowering parts) as long as they meet the no more than 0.3% requirement.

What this institution is saying is that hemp-derived cannabis products with less than o.3% THC are permitted for use in Canada.

What’s more, you can access these kinds of remedies without the need for a medical prescription.

Those of you who would like to get more potent cannabis with all its functions, you will have to follow the ACMPR.

The ACMPR (Access to Cannabis for Medical Purposes Regulations) are regulations meant to allow the buying and selling of full-strength cannabis oil in its natural form.

These regulations basically allow Canadians with qualifying medical conditions to get doctors prescriptions and to register and receive a card that will allow them to buy cannabis for medication. The regulations are strict with limits on what you can buy and when you can buy it.

This is in contrast to the industrial hemp regulations that allow the buying and selling of low THC oils  without prescription.

What about importing? Can you import?

Yes! If you want to buy cannabidiol oil with lower than 0.3% THC you can do it. Just buy from a reputable website and you will get it. Remember, the existing regulations exclude this type of cannabis oil from the Controlled Substances Act, which means you can buy as much of the supplement as you want without having to worry about anything.

What are politicians saying about this?

When the legislation passed for the use of recreational marijuana, the Justice Minister Wilson-Raybould urged Canadians to wait for the official date that marijuana will be legal before they start using.

The Prime Minister, Trudeau, announced that the exact date of legalization is October 17th. This means that by that date Canadians will be able to buy fresh marijuana and cannabis oil from licensed stores.

However, even now, Canadians have access to hemp oil that contains cannabidiol and many of the same benefits the full-strength cannabis oil has.

Conclusion and where to buy

There is a lot of controversy surrounding cannabis oil. You will see many articles saying that it is not legal while some say that it is illegal. This makes the whole situation rather murky and confusing. We have provided evidence and links to a government institution that clearly states that hemp oil is legal in Canada.

Furthermore, cannabis and cannabis oil will also be legal later this year and the authorities are okay with it (it was passed in parliament after all). So we do not expect the government to move to prevent the trade of low-THC CBD oils anytime soon.

There are dozens of e-commerce stores that sell CBD products online. Some are local others are international. We have reviewed some of these stores on our websites. Find the best ones and try today to start enjoying the benefits of CBD oil today.

P.S.: CBD oil is not meant to be used as medicine. It is strictly sold as a dietary supplement.
